Lupo Robert N in Moody Street was indefinitely suspended in 2006. (Admitted to practice: 1975) Lupo engaged in two separate acts of self-dealing where he used deception to further his interests to the detriment of his clients. One case involved real estate jointly owned by five elderly sisters, in which he, as their attorney, obtained consent of three of the sisters to act as their real estate agent, without telling them what fee he would charge or advising them to seek independent counsel. He didn’t tell the sisters of an offer that came in from the original broker they hired — who had agreed to a 5 percent fee. Later he told them that the offer came in through his listing service, but refused to act on that offer and another one until the remaining two sisters signed to let him serve as real estate agent. He said his fee was 10 percent. In a second case, he purchased the home of an aunt at greatly under its market value after telling her she needed to spend down her assets if the house were sold to later be eligible for Medicaid.
